AAP Files Comments on U.S. Department of Education Notice of Proposed Rulemaking

AAP's Higher Education Committee recently filed comments on the Department of Education Notice of Proposed Rulemaking regarding using Title IV funds to pay for books and supplies as part of tuition and fees. As the comments suggest, AAP has no issue with the Department allowing books and supplies to be included in tuition and fees, but does take issue with the Department’s caveat that these funds only be used for books and supplies not readily available in the marketplace. Since colleges and universities currently have the authority to include books and supplies as part of tuition and fees, the Department does not need to take action in this area. However, if the Department does decide to issue a regulation, it should require full transparency and employ the “value to students” concept, including financial and academic benefits to students.
